Terms of Service
These terms cover your use of Lunomi: the website, the dashboard and the API. By creating an account or using an API key, you agree to them.
1. The service
Lunomi ("we", "us") runs a paid API for the DeepSeek V4.1 Flash language model, compatible with the OpenAI and Anthropic APIs. You pay in advance by adding credit, and each request is charged from that credit by the tokens it uses, at the prices on the pricing page.
DeepSeek V4.1 Flash is an open-weight model made by DeepSeek. We serve it on our own infrastructure. We are not affiliated with DeepSeek, OpenAI or Anthropic; their names are used only to describe compatibility and are trademarks of their owners.
2. Your account
- You must be at least 18 years old and able to enter a binding contract.
- Give a real email address you control: we send sign-in codes and account notices to it.
- You are responsible for everything done with your account and its API keys. Keep your keys secret, and revoke any key you think has been exposed. Requests made with your keys are charged to your credit, whoever made them.
- One person or organisation may hold more than one account, but not to get around limits or a suspension.
3. Prepaid credit and prices
- Credit is bought in US dollars and paid in Bitcoin. A top-up is credited once the payment confirms. If you pay more or less than an invoice, you are credited what you actually paid, at the exchange rate fixed on the invoice.
- Credit does not expire while your account is open. It can only be spent on Lunomi. It is not money held for you, earns no interest, and cannot be withdrawn, sold or moved to another account.
- New requests are refused when your credit reaches zero. A request already running when that happens may finish and take your balance slightly below zero; your next top-up covers that first.
- We may change prices. A change applies to requests made after it takes effect, never to credit already used. We will post price increases on the pricing page and email you at least 14 days before they apply.
- Refunds are covered by the refund policy.
4. Acceptable use
You may build products on the API, including commercial ones. You may not use Lunomi to:
- break any law, or help someone else break one;
- create or share sexual content involving minors, or content that exploits or harms children in any way;
- make malware, run attacks on systems you are not authorised to test, or carry out fraud, phishing or spam;
- harass, threaten or impersonate real people, or produce targeted disinformation;
- get around our billing, credit checks, rate limits or security, probe or attack our systems, or try to see another customer's data;
- resell or share access to your account or API keys as a service of its own, without our written agreement.
You may not use Lunomi if you are located in, or ordinarily resident in, a country or region under comprehensive US sanctions, or if you are on a US government sanctions list.
5. Model output
The model's answers are generated automatically. They can be wrong, incomplete, out of date or offensive, and the same request can give different answers. Check anything important before you rely on it, and don't use the output as the only basis for decisions about someone's health, money, safety, legal rights or employment.
As between you and us, you own what you send and what the model returns to you, as far as the law allows. You are responsible for how you use the output and for making sure your use respects other people's rights. The model's own licence from DeepSeek also applies to its use.
6. Your data
We don't store the text of your prompts or the model's answers, and we don't train any model on them. What we do keep, and why, is in the privacy policy.
7. Availability and changes
We work to keep the service running, but we don't promise it will always be available, fast, or free of errors. We may change, add or remove features, models or limits. If we stop offering the service altogether, we will give you at least 30 days' notice and refund unused credit as the refund policy describes.
8. Suspension and closing your account
- You can delete your account at any time from the Account page. Deleting it ends your access, and any credit left on it is lost.
- We may suspend or close an account that breaks these terms, puts the service or other customers at risk, or is required to be closed by law. Where we reasonably can, we'll tell you why first and give you a chance to fix it. If we close an account for a reason that isn't a breach of these terms, we'll refund its unused credit.
9. No warranty
The service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement.
10. Limits on liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim arose. Some places don't allow these limits, so they may not all apply to you.
11. Your responsibility to us
If a third party makes a claim against us because of your content, your use of the output, or your breach of these terms, you agree to cover our reasonable losses and costs from that claim.
12. Governing law
These terms are governed by the laws of the State of California and the federal laws of the United States, without regard to conflict-of-law rules. Any dispute will be decided by the state or federal courts located in California, and you and we both consent to their jurisdiction.
13. Changes to these terms
We may update these terms. The date at the top says when they last changed. For a change that matters to you, we'll email you at least 14 days before it takes effect. Using the service after that means you accept the new terms; if you don't, you can delete your account, and any credit you bought in the 30 days before the change was announced is refunded on request.
14. The whole agreement
These terms, the privacy policy and the refund policy are the whole agreement between you and us about the service. If any part is found unenforceable, the rest still applies. Our not enforcing a part of these terms is not a waiver of it.
